Using Whittr
Terms of Use

1. Agreement
These Terms of Use govern your access to the Whittr website at whittr.app, the Whittr waitlist, recommended product links, and the Whittr iOS app (together, the “Service”). By using the Service, you agree to these terms and to our Privacy Policy.
If you do not agree, do not use Whittr.
2. The service
Whittr helps you plan a cosmetic whitening routine, capture personal progress photos, review shade estimates, and receive reminders and coaching. Features may change, and some capabilities depend on a paid subscription or on permissions you grant on your device.
Joining the waitlist does not guarantee access, a launch date, or any particular feature. Product availability on whittr.shop is handled by that shop, not by the Whittr app.
3. Eligibility
You must be at least 13 years old to use Whittr. If you use Whittr on behalf of someone else, you confirm you are allowed to do so. The Service is intended for personal, non-commercial use.
4. Cosmetic use only
Whittr provides cosmetic tracking estimates only. Shade scores, progress views, routines, product suggestions, and AI Coach replies are not a medical diagnosis, dental examination, or treatment plan. They can be affected by lighting, camera quality, hydration, and how a photo is taken.
Consult a dentist before starting or changing a whitening routine, especially if you have tooth pain, gum issues, restorations, or known sensitivity. Do not ignore professional advice because of something you see in Whittr. If you think you have a dental emergency, seek in-person care.
5. Accounts and subscriptions
You are responsible for the accuracy of your account information and for keeping your sign-in details confidential. You may delete your account from Profile in the app.
Paid plans are sold through Apple. Apple’s terms, billing, taxes, renewal, and refund rules apply to those purchases. Manage, cancel, or request a refund through your Apple ID settings or Apple Support. We may change plan features, except where Apple’s rules require otherwise.
6. Photos and content you provide
You retain rights in the photos and text you submit. You grant Whittr a limited license to host, process, display back to you, and back up that content so we can operate the Service. You confirm you have the right to submit the photos you scan or upload, and that they do not violate another person’s privacy or any law.
Do not submit content that is illegal, exploitative, or unrelated to your own cosmetic routine. We may remove content or suspend access if we reasonably believe these terms have been broken.
7. Acceptable use
You agree not to misuse Whittr, including by attempting to access another person’s account or scans, probing or disrupting our systems, reverse engineering the Service except where the law allows, using automated tools to overload the waitlist or APIs, or using Whittr to provide clinical services to patients.
8. Intellectual property
Whittr, the Whittr name, Pearl, Glim, and the site’s design, copy, and software are owned by Whittr or its licensors. These terms do not transfer ownership to you. You may not copy, scrape, or redistribute Whittr materials except for personal use of the Service.
9. Third-party services
The Service may link to shops, Apple, hosting providers, and other third parties. Their terms and privacy practices apply when you use them. Recommended product links may be affiliate links; Whittr may earn a commission if you buy through them. That does not change the price you pay.
10. Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Whittr disclaims warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that shade estimates will match a professional shade guide, that routines will produce any particular result, or that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, Whittr is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid to Whittr for the Service in the twelve months before the claim or CAD $50.
Some places do not allow certain limitations. In those places, our liability is limited to the maximum extent permitted by law. Nothing in these terms limits liability that cannot be limited, including liability for fraud or for death or personal injury caused by negligence where such a limit is prohibited.
12. Termination
You may stop using Whittr at any time and delete your account. We may suspend or end access if you violate these terms, if we discontinue the Service, or if we are required to do so by law. Sections that by their nature should survive, including intellectual property, disclaimers, and limitation of liability, will survive termination.
13. Changes
We may update these terms. The “Last updated” date will change when we do. If a change is material, we will take reasonable steps to notice it, such as posting it on this page. Continued use after the update means you accept the revised terms.
14. Governing law
These terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law rules. Courts located in Ontario will have exclusive jurisdiction, except that you may have additional mandatory rights in your place of residence, and Apple’s terms govern App Store billing disputes as applicable.
